These Terms of Service ("Terms") govern your access to and use of HQ Binaural Beats ("HQBB", "we", "us"), including our website, audio streaming, and the Audio Lab generator (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

HQBB provides streaming access to a catalog of binaural beats, isochronic tones, and ambient audio, plus tools to generate custom binaural audio. Features and content may change over time. A free tier and a paid subscription ("Pro") are offered; the features available to each are described on our pricing page and may be updated.

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service.

Paid subscriptions are billed in advance on a recurring monthly or annual basis through our payment processor, Stripe. By subscribing, you authorize recurring charges until you cancel.

You can cancel at any time from your account's billing portal; cancellation takes effect at the end of the current billing period, and you retain Pro access until then. We do not provide refunds for partial periods except where required by law. Prices may change on renewal with notice.

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable license to stream the content for your own non-commercial use. You may not download, copy, redistribute, resell, publicly perform, or create derivative works from the content, nor circumvent any access or usage limits.

The Service and its content are owned by HQBB or its licensors and are protected by intellectual-property laws. Except for the limited license above, no rights are granted to you.

HQBB's audio is intended for relaxation, focus, and entertainment. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition, and is not a substitute for professional medical advice.

Do not listen while driving, operating machinery, or doing anything that requires your full attention. If you have epilepsy, a seizure disorder, a heart condition, are pregnant, wear a pacemaker, or have any medical condition, consult a physician before use. Discontinue use and seek medical advice if you experience any adverse effects. You use the Service at your own risk.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, HQBB will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

We may suspend or terminate your access if you violate these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
